Terms of Use

1. Introduction

These Terms of Use govern your use of the Gym Gym workout tracker app and any related services provided through the app. By downloading, accessing, or using Gym Gym, you agree to these Terms. If you do not agree, do not use the app.

2. Owner

Gym Gym is provided by N.C.A. Vertelman. Contact: devkoosv@gmail.com.

3. Apple App Store

If you downloaded Gym Gym from the Apple App Store, these Terms are between you and N.C.A. Vertelman, not Apple. Apple is not responsible for the app or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable.

4. Eligibility and License

You may use Gym Gym only in compliance with applicable law, and you confirm you are legally permitted to use the app and to purchase subscriptions or in-app purchases through your Apple account where applicable.

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Gym Gym for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by Apple's usage rules and applicable terms.

The app license is also subject to the Apple Standard EULA.

5. What Gym Gym Does

Gym Gym is a workout tracking app for logging workouts, exercises, sets, reps, weights, workout history, and related training information. Some features depend on Apple services such as Apple Health, iCloud, StoreKit, and the App Store. Features may change, be improved, or be removed over time.

6. Free Access and Gym Gym Pro

Gym Gym can be used for free with limited access. Free users can add up to 3 sessions per exercise and view up to 7 days of workout history.

Gym Gym Pro gives you full access, including unlimited workouts per exercise and full workout history access. Gym Gym Pro can be accessed through a monthly subscription, yearly subscription, or one-time lifetime purchase where available in the app.

The exact features included in the free version and Gym Gym Pro may change over time. Any paid options, prices, subscription durations, trial terms, and purchase terms are shown in the app before purchase.

7. Health and Fitness Disclaimer

Gym Gym is intended for informational and tracking purposes only. It does not provide medical advice, diagnosis, or treatment. You are solely responsible for your training, exercise choices, physical condition, and health decisions. Use appropriate judgment and consult a qualified medical professional where necessary before starting or changing any exercise program.

8. Apple Health Integration

With your permission, Gym Gym writes workout start and end times to Apple Health. HealthKit access is optional and can be enabled or disabled at any time through your device settings and the Apple Health app. Your use of Apple Health is also subject to Apple's own terms and policies.

9. Subscriptions, Lifetime Purchase, Payments, and Refunds

Gym Gym offers monthly and yearly auto-renewing subscriptions, as well as a one-time lifetime purchase to access Gym Gym Pro. Subscription features, lifetime purchase features, prices, durations, and any free trial terms are shown in the app before purchase.

All purchases, billing, free trials, renewals, cancellations, refunds, and payment processing are handled by Apple through the App Store using StoreKit. We do not collect or process your payment card details.

Auto-renewing subscriptions renew automatically unless cancelled through your Apple App Store account settings. If a free trial is offered, the applicable terms are shown in the app before you subscribe. Unless cancelled before the trial ends, the subscription automatically converts into a paid subscription through Apple according to the terms shown during purchase.

The lifetime purchase is a one-time in-app purchase. It does not renew. It gives you access to Gym Gym Pro for the Apple account used for the purchase, subject to Apple's App Store, StoreKit, and purchase restoration rules.

You can manage or cancel subscriptions through your Apple App Store account settings. All purchases are final except where required by applicable law or where Apple's refund policies apply. Billing disputes and refund requests must be handled through Apple.

10. Acceptable Use

You agree not to:

• use the app for any unlawful purpose;
• copy, modify, reverse engineer, decompile, or extract source code from the app except where permitted by law;
• interfere with the operation or security of the app;
• use the app in a way that could damage, disable, or impair it or related services;
• violate the rights of the owner or any third party.

11. Intellectual Property

The app, including its design, text, graphics, logos, software, features, and other content, is owned by N.C.A. Vertelman or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the app except as expressly permitted by these Terms or by law.

12. Privacy

Your use of Gym Gym is also subject to the Gym Gym Privacy Policy. Please review it to understand how information is handled.

13. Availability and Changes

We may update, modify, suspend, or discontinue any part of the app at any time. We do not guarantee that the app or any feature will always be available, uninterrupted, or error-free.

14. Disclaimer of Warranties

To the fullest extent permitted by law, Gym Gym is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.

15. Limitation of Liability

To the fullest extent permitted by law, N.C.A. Vertelman shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or business arising out of or related to your use of, or inability to use, Gym Gym.

To the fullest extent permitted by law, total liability for any claim relating to Gym Gym shall not exceed the amount you paid for the app, subscriptions, or lifetime purchase in the 12 months before the event giving rise to the claim, or EUR 50 if you have paid nothing.

16. Termination

We may suspend or terminate your access to Gym Gym if you violate these Terms or if necessary to protect the app, its users, or applicable law. You may stop using the app at any time.

Deleting the app does not automatically cancel an active subscription. Subscriptions must be managed or cancelled through your Apple App Store account settings.

17. Consumer Rights

Nothing in these Terms limits any consumer rights that cannot be excluded under applicable law. If you are a consumer in the European Union, you may benefit from mandatory protections under the laws of your country of residence.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands, except to the extent mandatory consumer protection laws in your country of residence provide otherwise. Any disputes arising out of or relating to these Terms shall be submitted to the competent courts of the Netherlands, unless applicable consumer law provides otherwise.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and publish the updated Terms in the app or on this page. Your continued use of the app after the updated Terms take effect means that you accept the revised Terms.
